Insurance companies owe a duty to policyholders to pay valid claims, or to defend or settle valid third-party claims brought against their insured. At the same time, insurance carriers owe a duty to their shareholders to investigate every claim, and to only pay benefits where both coverage and liability are clear, and the amount sought accurately reflects the actual value of the claim.
